Associate Counsel with the BCCLA Ragi Mangat says right now court decisions are made separately for sentences and forfeitures of offense related property.
But, she says, that leaves a lot out of the decision making process…
“the court won’t take into consideration that this person has had this type of sentence already, what the effect of the forfeiture would have on that person or on other people who are maybe innocent third parties users of the property”
Mangat says they want to see the Crown’s requests for forfeiture made alongside the rest of the sentencing.
