Crown won’t appeal Robinson’s sentence

As expected, Crown prosecutors will not appeal the one-year conditional sentence handed to former RCMP Cpl. Monty Robinson last month, after he was convicted of obstructing justice.

Neil Mackenzie with the Criminal Justice Branch has released a two-page statement outlining three reasons: No errors in law were made by the judge, the conditional sentence Robinson received fell within guidelines set by Crown, and a higher court would likely defer to “the judge’s exercise of discretion.”

Mackenzie says the branch doesn’t usually explain its reasons for decisions, but an exception has been made in this case because it has attracted “significant public attention.”

He adds the fact a sentence is different from what Crown suggests does not mean it was “demonstrably unfit.”

Prosecutors had sought a jail term for up to nine months.
