Delta named as defendant in impaired driving lawsuit

Delta taxpayers could be on the hook for damages in the car crash that killed four-year-old Alexa Middelaer in 2008.

Alexa’s aunt, Daphne Middelaer, has filed a lawsuit against Carol Berner, the woman convicted of impaired driving causing the little girl’s death.

Middelaer was standing with her neice on the grass near 64th street when they were struck by Berner’s car.

Her lawyer argued in BC Supreme Court the speed bumps along 64th were not spaced out according to national guidelines, and could have contributed to Berner losing control of her car.

The court has ruled the corporation of Delta be added as a defendant in Middelaer’s suit.

Delta has also been named in other legal actions related to the tragic car crash, including one made by Alexa’s parents for family compensation.
