Kidnapping conviction upheld

A man who wasn’t involved in physically abducting a UBC student six years ago has had his kidnapping conviction upheld by Canada’s highest court.

28-year-old Sam Tuan Vu was originally acquitted at trial for the kidnapping of Graham McMynn, but convicted of unlawful confinement, because he wasn’t physically there when the then 23-year-old was taken in Vancouver.

But the kidnapping acquittal was overturned by the BC Court of Appeal.

Now, in a unanimous decision, the Supreme Court of Canada has upheld Vu’s conviction — saying Vu knowingly took part in holding McMynn against his will, and was therefore a party to the kidnapping.

Two other people were convicted of kidnapping McMynn, while another two were acquitted, including Vu’s brother.
