No jail for abusive aunt: B.C. appeals’ court

VANCOUVER – The B.C. Court of Appeal will not incarcerate a woman who pleaded guilty to aggravated assault and failure to provide the necessities of life in relation to her three-year-old niece.

The woman, who can not be identified, pleaded guilty in First Nations Court on June 11, 2011 and was sentenced to two years less a day to be served conditionally and three years of probation.

According to court documents, the woman brought her niece to hospital _ she was suffering from extensive burns and bruises to her entire body and a severe head injury.

Crown counsel appealed the sentence.

In her ruling, appeal court Justice Elizabeth Bennett writes that while the sentence is not fit, imposing time behind bars would not be in the interests of justice.

Bennett notes the conditional sentence includes orders to attend psychiatric and native court worker services.
