Judgment reserved on appeal by anti-abortion activist in Vancouver

BC’s highest court has reserved judgment on the appeal of an anti-abortionist convicted of violating a so-called bubble zone outside a Vancouver health clinic.

Cecelia von Dehn was arrested for breaching the Access to Abortion Services Act in June of 2009.

At the time, she was demonstrating outside the Everywoman’s Health clinic at Commercial and Broadway.

She was later sentenced to two years probation and fined $ 1000.

Her lawyers say she did not violate Bill 48, which bans protests against the termination of pregnancies, because she was demonstrating against the bill itself –not abortion.

Crown Counsel Mary Ainslie disagrees saying the Act is clear about no violations -of any kind– within the bubble zone.

The BC Court of Appeal has reserved judgment to a later date.
