The NDP and the Government are sparring once again, this time over changes to the DUI legislation made after the Courts ruled some portions were unconstitutional.
Attorney-General critic Leonard Krog says it remains to be seen if the changes will pass muster in Court, “The fact that they are having to introduce this legislation shows that last time they didn’t listen to people who indicated there would be constitutional issues, including Opposition and the fact they rammed it through quickly last time.”
However, Justice Minister Shirley Bond isn’t buying it, as she defends the legislation, “Perhaps the NDP forgot that during the Sivia case in fact, the Judge upheld the Provinces’ ability to put an administrative penalty system in place. They did say you need to make some adjustments here; gave us until the end of June.”
Included in the changes is a requirement that police tell drivers they can have a second test, with the lower of the two standing in a dispute.
