DUI changes may result in more Court time being needed

The BC Government’s changes to parts of its drunk-driving laws struck down last fall will likely only invite further challenges in Court.
 
So says Jeremy Carr, a Victoria lawyer who helped have those very laws deemed unconstiutional.

The Government has come up with new laws to address a Court order, including having police tell a driver he can challenge the first breathalyzer test with a second one. But Carr says they’re not much different than the laws before, “Most officers were being fair in advising you that you have an opportunity for a second test. So, most of that was being done. But I just think the issue is, after the fact, what are you able to do to properly question the results?”

Carr adds you have more rights if you are caught for speeding, being able to take your case before a Justice of the Peace to have him question the officer. He says that is what really lacks in the drunk-driving legislation.
